These website terms explain the basis on which FSG receives and evaluates an employer sourcing brief. Commercial fees, guarantees and assignment-specific terms are confirmed separately where FSG accepts the instruction.

FSG Website Sourcing-Brief Terms

1. What a submitted brief means

Submitting a sourcing brief asks Franchise Staffing Group (FSG), a recruitment business within DigiLinx Incorporated, to review a recruitment or staffing requirement. Submission alone does not oblige FSG to accept the assignment and does not replace any quotation, fee schedule, statement of work or service agreement later agreed for the assignment.

2. Accuracy of the brief

The client should provide materially accurate information about the role, location, remuneration or budget context, target timing, required experience, lawful selection criteria and any site, safety or screening requirements that could affect the search.

3. Employment Equity / transformation requirements

Where the client identifies an Employment Equity, transformation or B-BBEE-related consideration, FSG will discuss the requirement with the client and apply only criteria that can lawfully and appropriately be used in the recruitment process. FSG may ask for clarification before acting on any such instruction.

4. Candidate information

Candidate profiles and personal information supplied by FSG are confidential and may be used only for the legitimate recruitment purpose for which they are supplied. Candidate information should be shared only with people who reasonably need it to make the hiring decision.

5. Screening and verification

Where agreed, FSG may coordinate references, qualification checks, assessments or other lawful screening. Screening does not replace the client’s responsibility for its final employment decision or its own statutory and workplace obligations.

6. Fees and commercial terms

Any placement fee, project fee, invoice trigger, payment term, guarantee or replacement arrangement applies only as set out in the quotation, fee schedule or service agreement confirmed for the assignment. The website does not create a default fee percentage or guarantee.

7. Candidate introductions

Where FSG introduces a candidate and the client later employs or engages that candidate, any agreed introduction-protection and fee provisions will be governed by the commercial terms confirmed for the assignment.

8. Timelines

FSG will work toward agreed target dates but does not guarantee a particular time-to-fill, opening date or fill rate unless that commitment is expressly agreed in writing. Labour-market availability, client feedback, screening requirements, notice periods and changes to scope can affect timing.

9. Flexible / contract / TES requirements

Temporary, contract or TES-related requirements may need separate legal, registration, payroll, site-safety and commercial checks before FSG can accept or deploy the assignment. A website brief does not by itself activate a TES arrangement.

10. Privacy and records

Information submitted through the website is used to review and manage the recruitment or staffing requirement. FSG will process recruitment-related information subject to applicable privacy and record-keeping requirements. See the Privacy Notice.

11. Governing context

FSG operates in South Africa. Any final service agreement will be interpreted with reference to the applicable South African law and the terms specifically agreed for that service.

12. Terms-view record

The website records the date/time and version of these terms when the employer opens them from the sourcing brief. This is a record that the terms were presented and opened; it is not presented as a digital signature.
